This privacy notice provides you with details of how we collect and process your personal data through your use of our site soulflowmechanics.com and as a client/customer of Unveil Enterprises, LLC.,  DBA Soul Flow Mechanics, including any information you may provide through our site when you purchase a product or service, sign up to our newsletter or take part in a prize draw or competition.

By providing us with your data, you warrant to us that you are over 13 years of age.

Soul Flow Mechanics, LLC is the data controller in most cases and we are responsible for your personal data (referred to as “we”, “us” or “our” in this privacy notice).

2. WHAT DATA DO WE COLLECT ABOUT YOU

Personal Data means any information capable of identifying an individual. It does not include anonymized data.

Soul Flow Mechanics may process certain types of personal data about you as follows:

  • Identity Data may include your first name, maiden name, last name, username, marital status, title, date of birth and gender.

  • Contact Data may include your billing address, delivery address, email address and telephone numbers.

  • Financial Data may include your bank account and payment card details.

  • Transaction Data may include details about payments between us and other details of purchases made by you.

  • Technical Data may include your login data, internet protocol addresses, browser type and version, browser plug-in types and versions, time zone setting and location, operating system and platform and other technology on the devices you use to access this site.

  • Profile Data may include your username and password, purchases or orders, your interests, preferences, feedback and survey responses.

  • Usage Data may include information about how you use our website, products and services.

  • Marketing and Communications Data may include your preferences in receiving marketing communications from us and our third parties and your communication preferences.

We may also process Aggregated Data from your personal data but this data does not reveal your identity and as such in itself is not personal data. An example of this is where we review your Usage Data to work out the percentage of website users using a specific feature of our site. If we link the Aggregated Data with your Personal Data so that you can be identified from it, it is treated as personal data.

The personal data described above may relate to any of the following categories of person:

We are committed to safeguarding your personal information. Whenever you provide personal information (for example your email address, date of birth, telephone number, full name, next of kin or healthcare details) we are legally obliged to use your information in line with all laws concerning the protection of personal information.

Sensitive Data

At Soul Flow Mechanics we collect medical data; information about your health, and genetic and biometric data. There may be times we collect other sensitive data about you, where you directly provide us with this. Other sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership. We do not explicitly collect any information about criminal convictions and offenses, though these may be stored in your record within documentation created for your use only.

We require your explicit consent for processing sensitive data, so when you submit your details we ask you to confirm your consent to this processing. We treat sensitive data under the legislation of Special Category Data.

In addition, all laboratories and third parties that Dasein Health, LLC. chooses to work with are vetted by ourselves to comply with stringent data protection, privacy and confidentiality laws.

Where we are required to collect personal data by law, or under the terms of the contract between us, and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). If you don’t provide us with the requested data, we may have to cancel a product or service you have ordered but if we do, we will notify you at the time.

3. HOW WE COLLECT YOUR PERSONAL DATA

We collect data about you through a variety of different methods including:

Direct interactions - you may provide data by filling in forms on our site (or otherwise) or by communicating with us by post, phone, email or otherwise, including when you:

  • order our products or services;

  • work with us;

  • network online or offline with us;

  • create an account on our site;

  • subscribe to our service or publications;

  • request resources or marketing be sent to you;

  • enter a competition, prize draw, promotion or survey; or

Automated technologies or interactions - as you use our site, we may automatically collect Technical Data about your equipment, browsing actions and usage patterns. We collect this data by using cookies, server logs and similar technologies. We may also receive Technical Data about you if you visit other websites that use our cookies. Third parties or publicly available sources - depending on your settings or the privacy policies for other online services, you may give us permission to obtain information from your account with those other services such as analytics providers, advertising networks and search information providers. For example, this can be via social media or by choosing to send us your location data when accessing our Site from your smartphone. Upon acceptance of our policy, we can track your behavior on our Site from social media, direct, referral, organic or email traffic using Facebook Pixel and Google Analytics. We may also receive personal data about you from public sources.

Social media and internet based advertising - Soul Flow Mechanics utilizes social media in its marketing and advertising. When you interact with Soul Flow Mechanics, related social media content, for example, “liking” content on our Instagram page (and that of Caleb Greer, Victoria Greer, Julie Kaesberg MD, or other staff members), such interaction may allow us to collect your IP address or the page you are visiting from. Cookies may also be enabled to allow various features to function properly. Interactions on social media are subject to the privacy policy of the social media service provider. We reserve the right to use LinkedIn, Facebook, Twitter, Instagram and YouTube advertising services, and as such there are tracking codes such as a Facebook Pixel and Google Analytics installed on our Site so that we can manage the effectiveness of these campaigns. We do not store any personal data within this type of tracking.

Ads appearing on the Site may be delivered to Users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile non personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This privacy policy does not cover the use of cookies by any advertisers.

Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies.

We do not make, and do not allow any of these third parties to make, any attempt to find out the identities of those visiting our Site.

Generally, we do not rely on consent as a legal ground for processing your personal data, other than in relation to sending marketing communications to you via email, customized online advertising or text message. Marketing communications:

You will receive marketing communications from us if you have:

(i) requested information from us or purchased goods or services from us; or

(ii) if you provided us with your details and ticked the box at the point of entry of your details for us to send you marketing communications; and

(iii) in each case, you have not opted out of receiving that marketing.

DSoul Flow Mechanics will not sell or rent your personally identifiable information, gathered as a result of filling out the Site newsletter sign up forms, to anyone. Soul Flow Mechanics may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with the business partners, trusted affiliates and advertisers for the purposes outlined above. We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

We use a third party provider to process your subscription and deliver our newsletter. We gather statistics around email opening and clicks using industry standard technologies to help us monitor and improve our e-newsletter. You can unsubscribe to general mailings at any time by clicking the unsubscribe link at the bottom of any of our emails or by emailing us. If at any time you would like to unsubscribe from receiving future emails, you can email us at hello@soulflowmechanics.com and we will promptly remove you from ALL marketing correspondence.

Where you opt out of receiving our marketing communications, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for a purpose unrelated to the purpose for which we collected the data, we will notify you and we will explain the legal ground of processing.

5. DATA SECURITY  

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

Access to personal data and information

Only practitioners registered with Soul Flow Mechanics have access to our systems and data storage. We use accredited, centralized, third-party practice management systems bound by US law with regard to HIPAA, data protection, privacy, confidentiality and storage. Computers which have access to these systems are password and/or fingerprint protected.

Only practitioners assigned to specific patients have access to their data. In such a way, whilst we are an integrated team, your data is only shared with practitioners not involved in your care with your express permission (in writing, via email), and upon request for referrals, in which case your data is transferred from one HIPAA-covered entity to another.

We are a paperless practice. All of our data is held electronically. We store no paper records and in cases where information is received in paper form it is digitized and the paper copy securely destroyed.

We will store your personal data in line with all laws pertaining to the treatment of medical data and policies under HIPAA.

Our Site is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our Site as safe as possible. We do not use Malware Scanning.

All sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. When you are on a secure page, a lock icon will appear in the address bar of your browser.

We implement a variety of security measures when a User places an order, hires us, enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider (PayPal or Stripe) or a bank transfer and are not stored or processed on our servers. Payment and login information are encrypted.

Non-sensitive details (e.g. your name, email address) are sent normally over the internet and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us and you do so at your own risk.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

6. YOUR CONSENT TO SHARE YOUR INFORMATION VIA EMAIL

As part of administering an effective, concierge medical service, we transmit your data via secure email service directly to you.

We utilize secured transfer of data, but we cannot guarantee the privacy of your data once our communication reaches your devices.

Commencing work with Soul Flow Mechanics and the signing of any Practice Expectations is taken as acknowledgement and acceptance of our way of communicating with you, and that you take any measures necessary to secure your personal health data on your own devices.

7. DATA RETENTION  

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Deletion of personal data

Any individual has a right to request erasure of their personal information at any time. However, medical data contains notable exceptions, including::

  1. medical diagnosis

  2. the provision of health or social care

  3. the management of health or social care systems or services

Soul Flow Mechanics operates as a healthcare service provider through our third-party relationship with Julie Kaesberg, PLLC: medical and healthcare data is deemed as exempt from deletion or erasure upon patient request in the majority of cases until retention schedule limits are met.

At Soul Flow Mechanics we comply with HIPAA record retention requirements. All HIPAA-related documents must be retained for a minimum of six years from the date of administration of service.

Our records are all electronic and our systems allow for metadata sub data records to be retained so deletion takes place in accordance with an 6 year retention policy.

Additionally, by law, we have to keep basic information about our clients/customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being clients/customers for tax purposes.

In some circumstances - notably those in which the data you have provided data is not medical in nature - you can ask us to delete your data: see below for further information.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes. However, at Soul Flow Mechanics we are committed to asking your express permission before utilizing your data in this way.

8. YOUR LEGAL RIGHTS  

Under certain circumstances, you have rights under data protection laws in relation to your personal data. These include the right to:

  • Request access to your personal data

  • Request correction of your personal data

  • Request erasure of your personal data

  • Object to processing of your personal data

  • Request restriction of processing your personal data

  • Request transfer of your personal data

Right to withdraw consent

You have the right to withdraw consent to the holding of your personal data at any time.

As laid out above, this applies to personal data - though will not apply to medical data held on our systems.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Choosing how we use your personal data

We understand that you trust us with your personal information and we are committed to ensuring you can manage the privacy and security of your personal information yourself.

With respect to the information relating to you that ends up in our possession, and recognising that it is your choice to provide us with your personal data, we commit to giving you the ability to do all of the following:

  • You can also contact us by the same method to change, correct, or delete your personal information controlled by Soul Flow Mechanics regarding your profile at any time. Please note that if you have shared any information with others through social media channels, that information may remain visible, even if your account is deleted.

You can unsubscribe from receiving marketing emails from us by clicking the “unsubscribe” link at the bottom of any email. Once you do this, you will no longer receive any emails from us unless you select you would still like to receive emails about an individual topic or you explicitly provide consent in future.
